These Terms and Conditions (“Terms”) govern your use of visualounge.com and the companion application at app.visualounge.com (together, the “Services”), operated by VISUALOUNGE. By browsing the blog, creating an account, or submitting content, you agree to these Terms. If you don’t agree with any part of them, please don’t use the Services.

These Terms work together with our Privacy Policy, which explains how we handle personal data. By using the Services you also agree to that policy.

1. About the Services

Visualounge is an online magazine of daily inspiration, publishing curated work by artists, designers, photographers, and creative enthusiasts from around the world. The app at app.visualounge.com extends that mission: it lets you register, log in, and submit your own work for consideration. These Terms apply to the magazine and the app alike.

2. Using the Services

You agree to use the Services lawfully and only for their intended purpose. In particular, you may not:

  • interfere with or disrupt the Services, its servers, or connected networks;
  • attempt to gain unauthorized access to any account, system, or data;
  • scrape, crawl, or harvest content from the Services at scale without our permission;
  • use the Services to break any applicable law or regulation.

3. Your Account

To submit content through the app, you need an account. When you register, you agree to provide accurate and complete information and keep it up to date. You are responsible for everything that happens under your credentials, so keep your password safe and let us know immediately if you suspect unauthorized use. Accounts that are misused, or used to breach these Terms, may be suspended or terminated at any time. You must be at least 16 years old to create an account; if you are under 16, please involve a parent or legal guardian before using the Services.

One detail worth knowing up front: confirming your account in the app also subscribes you to the Visualounge newsletter — the easiest way to keep up with new features and fresh inspiration. You can unsubscribe at any time through the link in any newsletter email, and opting out will never affect your account or your submissions.

4. Submissions and Moderation

We are an editorial publication, not a hosting service, and every submission is reviewed by a human before it can appear anywhere on Visualounge. What that means in practice:

  • acceptance is never guaranteed;
  • we may request revisions, additional material, or clarification before publishing;
  • we may edit or reformat submissions for presentation — credit always stays with you;
  • we may reject any submission at our discretion, without being obliged to explain our decision;
  • being featured once creates no expectation of future publication.

5. Rights You Grant to Us

By submitting content, you confirm that it is yours to share and that it does not infringe anyone else’s rights. You grant VISUALOUNGE a non-exclusive, worldwide, royalty-free license to display, reproduce, distribute, and promote your submission across the Services and our promotional channels, with reasonable credit to you. You keep full ownership of your work, and nothing in these Terms transfers that ownership.

6. Content Standards

Submissions and any other content you provide must not:

  • be unlawful, defamatory, hateful, or harassing;
  • infringe the copyright, trademark, privacy, or other rights of anyone else;
  • contain spam, malware, or deceptive material;
  • misrepresent who you are or the origin of the work.

7. Intellectual Property

The Services themselves — text, design, logos, and code — are owned by or licensed to VISUALOUNGE and may not be copied or reused without permission. Work published on the blog belongs to its creators and is shown with their permission or credited attribution. Nothing in these Terms gives you any rights in the Services beyond those granted here.

8. Third-Party Links

The blog and app may link to external websites. We don’t control those sites and aren’t responsible for their content, policies, or availability. Following such links is at your own risk.

9. Disclaimer of Warranties

The Services are provided “as is” and “as available,” without warranties of any kind — express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t guarantee that the Services will be uninterrupted or error-free, or that published work will remain online indefinitely.

10. Limitation of Liability

To the maximum extent permitted by law, VISUALOUNGE and its team will not be liable for any indirect, incidental, special, or consequential damages — including lost profits, data, or goodwill — arising from your use of the Services or from any submission, even if we were advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold VISUALOUNGE and its team harmless from any claims, damages, or expenses — including reasonable legal fees — arising from your use of the Services, your submissions, or your breach of these Terms.

12. Changes to These Terms

We may update these Terms from time to time. When we do, the “Last updated” date at the top of this page changes and the new version takes effect as soon as it is posted. If a change is significant, we’ll do our best to flag it. Continuing to use the Services after a change means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which VISUALOUNGE is established, without regard to conflict-of-law principles. If you are a consumer in the European Union, nothing in these Terms limits rights you hold under the mandatory consumer-protection laws of your country of residence. We’ll always try to resolve disputes informally first — just contact us.
